These Terms of Service (“Terms”) govern your use of the National Mortgage Assistance website (the “Site”) and our services, including our SMS messaging program. For information on how we handle your personal data, see our Privacy Policy.
1. Acceptance of terms
By accessing the Site, submitting our consultation form, or opting in to our SMS program, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.
2. About our services
National Mortgage Assistance provides HUD-certified counseling and loss-mitigation support to homeowners in the United States. We are not a law firm or government agency and are not affiliated with any government program. Information on this Site is for general purposes and is not legal, financial, or tax advice.
3. Eligibility
You must be at least 18 years old and a resident of the United States to use our services or opt in to our SMS program. You may only enroll a phone number that you own or are authorized to enroll.
4. No guarantee of outcome
Outcomes of foreclosure prevention and related negotiations depend on factors outside our control, including the policies of your mortgage servicer, your financial circumstances, and applicable law. We do not guarantee any specific result, payment reduction, or foreclosure postponement.
5. SMS messaging program (A2P 10DLC)
When you check the SMS-consent box on our consultation form, you opt in to receive text messages from National Mortgage Assistance. The following terms govern that program.
- Program description: Account-related notifications, appointment reminders, document requests, and case updates from a counselor.
- Message frequency: Recurring messages; frequency varies based on the status of your case. Typically fewer than 10 messages per month.
- Cost: Message and data rates may apply. Charges are set by your mobile carrier, not by us.
- Opt-out: Reply STOP at any time to any message to unsubscribe. You will receive a final confirmation that you have been opted out, after which we will not send you SMS messages unless you opt in again.
- Help: Reply HELP to any message, or contact us at (888) 238-0086 or info@nationalmortgageassistance.net.
- Carriers: Supported on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
- Consent is not a condition of service. You can request and receive a free consultation without opting in to SMS.
- Eligible numbers: Only U.S. mobile numbers are eligible. Do not enroll a number you do not own or are not authorized to enroll.
- Privacy: See our Privacy Policy for how we handle SMS data. We do not share mobile numbers or SMS opt-in data with third parties for marketing.
6. Fees
Initial consultations are free. Where we charge fees for ongoing services, those fees are disclosed to you in writing before any engagement begins, and we do not collect advance fees for foreclosure-prevention work in jurisdictions where doing so is prohibited.
7. Acceptable use
You agree not to:
- Submit false, misleading, or fraudulent information through the Site.
- Enroll a phone number that you do not own or are not authorized to enroll.
- Use the Site or SMS program for any unlawful purpose.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Site, our systems, or the SMS program.
8. Intellectual property
All content on the Site — including text, graphics, logos, and images — is owned by or licensed to National Mortgage Assistance and is protected by U.S. and international intellectual-property laws. You may not reproduce or distribute Site content without our written permission.
9. Disclaimers
The Site and our services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that SMS messages will be delivered on time or at all.
10. Limitation of liability
To the fullest extent permitted by law, National Mortgage Assistance and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site, our services, or the SMS program — including but not limited to lost profits, lost opportunities, or damages from undelivered or misdirected messages. Our total liability for any claim relating to these Terms will not exceed the fees you paid us, if any, in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless National Mortgage Assistance from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site or SMS program, or your enrollment of a phone number you were not authorized to enroll.
12. Termination
We may suspend or terminate your access to the Site or SMS program at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may opt out of SMS at any time by replying STOP, and you may stop using the Site at any time.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Site or SMS program after changes are posted constitutes acceptance of the updated Terms.
